This website is operated by TRM Metal Products. Throughout the site, the terms "we", "us", and "our" refer to TRM Metal Products. We offer this website, including all information, tools, and services available from it, to you, the user, conditioned on your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service, including the additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

Any new features or tools added to the store are also subject to these Terms. Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content, not including credit card information, may be transferred unencrypted and may involve transmission over various networks and changes to conform to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
Headings in this agreement are for convenience only and do not limit or affect these Terms.
Section 3 – Accuracy, Completeness, and Timeliness of Information
We are not responsible if information on this site is not accurate, complete, or current. Material on this site is provided for general information only and should not be relied on as the sole basis for a decision without consulting more accurate, complete, or timely sources. Any reliance on material on this site is at your own risk.
This site may contain historical information, which is not current and is provided for reference only. We may modify the contents of this site at any time but have no obligation to update any information.
Section 4 – Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service, or any part of it, without notice at any time. We are not liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
Section 5 – Products and Services
Certain products may be available exclusively online through this website. These products may have limited quantities and are subject to return or exchange only in accordance with our Return, Refund, and Pre-Order Policy.
We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your monitor's display of any colour, including powder coat finishes, will be accurate. If exact colour matching matters to your project, contact us for a physical sample before ordering.
We reserve the right, but are not obligated, to limit the sale of our products to any person, geographic region, or jurisdiction, and to limit the quantities of any product we offer. All product descriptions and prices are subject to change at any time without notice at our sole discretion. We may discontinue any product at any time. Any offer for any product made on this site is void where prohibited.
We do not warrant that the quality of any product, service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Section 6 – Custom-Size and Made-to-Order Products
Many of our products are manufactured to the dimensions you supply. The following applies to all custom-size, made-to-order, and preorder items:
- The dimensions you enter at checkout are the exact dimensions we manufacture. We do not adjust, round, or interpret them.
- You are responsible for measuring the duct opening or cutout correctly, not your existing vent cover. We are not responsible for a product that does not fit because of a measurement supplied by you.
- Production time is approximately three to four weeks. The shipping method you select affects transit time only, not production time.
- Orders for these products may be cancelled within 24 hours of purchase for a full refund. After 24 hours they are non-cancellable, non-returnable, non-refundable, and non-exchangeable, as set out in our Return, Refund, and Pre-Order Policy.
- Manufacturing defects and shipping damage are always covered, including on custom and preorder items.
Section 7 – Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, at our discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed under the same customer account, the same credit card, or the same billing or shipping address. If we change or cancel an order, we may attempt to notify you using the email address, billing address, or phone number provided at the time of the order. We reserve the right to limit or prohibit orders that in our sole judgment appear to be placed by dealers, resellers, or distributors. Wholesale and trade customers should contact us directly to set up a trade account.
You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update your account information, including email address, credit card numbers, and expiration dates, so we can complete your transactions and contact you as needed.

Section 8 – Shipping, Duties, and Customs
Shipping timelines, costs, and cross-border terms are set out in our Shipping Policy. For orders shipped to the United States, duties, taxes, and customs fees are covered by us unless stated otherwise at checkout. Title and risk of loss pass to you on delivery by the carrier.
We do not ship to PO boxes. You are responsible for providing a complete and accurate physical shipping address. We are not responsible for delays, additional charges, or losses caused by an incorrect or incomplete address supplied by you.
Section 9 – Optional Tools
We may provide access to third-party tools that we neither monitor nor control. You acknowledge that we provide access to such tools "as is" and "as available" without warranties, representations, or conditions of any kind and without endorsement. We have no liability arising from your use of optional third-party tools, and your use of them is entirely at your own risk. You should ensure you are familiar with and approve of the terms on which those tools are provided by the relevant third party.
We may offer new services or features through the website in the future. Those will also be subject to these Terms.

Content and services available through our Service may include material from third parties. Third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any third-party materials or websites or for any products or services of third parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, or content in connection with any third-party website. Review the third party's policies carefully before you transact with them, and direct any complaints about third-party products to that third party.
Section 11 – User Comments, Feedback, and Submissions
If you send us creative ideas, suggestions, proposals, plans, drawings, specifications, or other materials, whether at our request or not (collectively, "comments"), you agree that we may at any time and without restriction edit, copy, publish, distribute, translate, and otherwise use them in any medium. We are under no obligation to keep any comments confidential, to pay compensation for them, or to respond to them.
We may, but are not obligated to, monitor, edit, or remove content we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.
You agree that your comments will not violate the rights of any third party, including copyright, trademark, privacy, or other proprietary rights, and will not contain unlawful, abusive, or obscene material or any malware. You may not use a false email address or misrepresent your identity. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for comments posted by you or any third party.

Your submission of personal information through the store is governed by our Privacy Policy.
Section 13 – Errors, Inaccuracies, and Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such error and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice, including after you have submitted your order.
We undertake no obligation to update, amend, or clarify information in the Service except as required by law. No update or refresh date shown in the Service should be taken to indicate that all information has been modified or updated.

We reserve the right to terminate your use of the Service for violating any prohibited use.

All content on this site, including product designs, drawings, photographs, specifications, spec sheets, text, graphics, and logos, is the property of TRM Metal Products or its licensors and is protected by Canadian and international intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our prior written permission. Nothing on this site grants any licence or right to use any TRM Metal Products trademark.
Section 16 – Disclaimer of Warranties and Limitation of Liability
We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods or cancel it at any time without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products delivered to you through the Service are, except as expressly stated by us, provided "as is" and "as available", without any representation, warranty, or condition of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall TRM Metal Products, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, installation or removal costs, or any similar damages, whether based in contract, tort including negligence, strict liability, or otherwise, arising from your use of the Service or any product purchased through it.
Where liability cannot be excluded, our total liability to you for any claim arising out of or relating to a product or order is limited to the amount you paid us for that product. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability is limited to the maximum extent permitted by law.
Section 17 – Indemnification
You agree to indemnify, defend, and hold harmless TRM Metal Products and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
Section 18 – Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision is still enforceable to the fullest extent permitted by applicable law, and the unenforceable portion is severed from these Terms. That determination does not affect the validity and enforceability of the remaining provisions.
Section 19 – Termination
The obligations and liabilities of the parties incurred before the termination date survive termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our services, or by ceasing to use our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any provision of these Terms, we may terminate this agreement at any time without notice. You remain liable for all amounts due up to and including the date of termination, and we may deny you access to our services.
Section 20 – Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications, and proposals, whether oral or written, including any prior versions of these Terms. Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

These Terms and any separate agreements under which we provide you services are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
